Typical notices served to tenant:

• 3-Day pay rent or quit
• 3-Day to Perform Covenants or quit
• 30-Day notice to quit
• 60-Day notice to quit
• 3-Day/90-Day notice to quit—(foreclosures)

• “Combination notices” are also given in the event that a landlord wants to demand past-due rent within 3-days as well as demand possession from the tenant in 30 or 60 days.

• Some circumstances require other notices that may not be listed; in this event, our office will tailor-make a notice to fit your case needs for a low flat-rate fee.

Timeline:As Fast as the Law Allows

From start-finish (initial filing through sheriff’s lockout): 3-6 weeks
Factors in determining timeline include how the tenant is served the initial court paperwork (Summons & Complaint), and whether or not the case goes to trial.

A personal serve gives the tenant 5 days to contest the information and request a hearing date.
A sub-serve gives the tenant an additional 10 days.

If the tenant is unable to be served, a motion for an “Order to Post” is required. This document must be signed by a judge and can delay the process a few days. Once it is signed, it is mailed to the tenant; there is a 15-day allowance for the tenant to file an answer.

In the event that the tenant files an answer, the court will set a hearing date 11-21 days in the future. Once we receive notification of a hearing date & time we inform you via telephone, and follow-up with a letter.
